Users of Samsung Galaxy smartphones should be receiving an over-the-air patch that fixes a major security flaw: The phones could have all their data wiped just by visiting certain malicious?webpages.

The malware called up the phone's number pad and put in a?sequence one could use to return the phone to factory settings. It's a feature in Android that was exploited some time ago, but which manufacturers like Samsung have been slow to patch.

Any affected users?should be seeing the update arrive soon, if they haven't already.

Just how long does it take to get onto the federal bench these days? The molasses pace of the judicial confirmation process during the Obama presidency has been apparent. But now the Congressional Research Service has crunched the numbers and found clear proof that Senate Republicans are engaging in an unprecedented form of obstruction of President Obama?s judicial nominees. The Republicans are holding even the most uncontroversial nominees hostage, in an effort to leave as many seats as possible open for a future Republican president to fill. In short, the uncontroversial nominees are pawns in a fight over the future of the federal judiciary.

CRS defines an uncontroversial nominee as one with little or no opposition when votes are actually cast in the Senate Judiciary Committee and on the Senate floor. This definition isn?t perfect, because it allows senators to manufacture a ?controversy? simply by voting against a nominee, and some Republicans have now taken to voting against every Obama nominee, no matter what. But the CRS numbers are still striking. ?

The gist is this: The average confirmation time for uncontroversial circuit court nominees rose from 64.5 days under Reagan to 227.3 days under Obama. There simply are no Obama appeals court nominees who make it through the confirmation process in 100 days or less?whereas nearly 30 percent of President George W. Bush?s nominees sped through in that amount of time. Similarly, the average waiting time for uncontroversial district court nominees increased from 69.9 days under Reagan to 204.8 days under President Obama. And the number of district court nominees who wait more than 200 days has doubled from George W.?s time to Obama?s.

The slowdown is bad because it surely means that some of the best judicial candidates decide not to put themselves through this stalled process. It also leaves unfilled vacancies that the judiciary has declared ?emergencies? because of the heavy workload facing the sitting judges on those courts. Our federal judiciary, and the people it serves, deserve far better.

Libyan who helped capture Gadhafi dies

One of the young Libyan rebels credited with capturing Moammar Gadhafi in a drainage ditch nearly a year ago died Tuesday of injuries he allegedly sustained after he was kidnapped by the late dictator's supporters.

The death of Omran Shaaban, who had been hospitalized in France, raised the prospect of even more violence and score-settling, with the newly elected National Congress authorizing police and the army to use force if necessary to apprehend those who abducted the 22-year-old and three companions near the town of Bani Walid?in July.

His family claimed he was shot by gunmen, then captured and tortured by militiamen still loyal to Gadhafi.

Libya is battling lingering pockets of support for the old regime, and its government has been unable to rein in armed militias in a country rife with weapons. Earlier this month, a demonstration at the U.S. Consulate in the eastern city of Benghazi turned violent, killing four Americans, including U.S. Ambassador Chris Stevens.

Shaaban was praised as a "dutiful martyr" and a "brave hero" by the National Congress, which has?ordered the defense and interior ministries to find those who abducted Shaaban.

No reward
However, his family says he never received a promised reward of 1 million Libyan dinars ($800,000) for capturing Gadhafi on Oct. 20, 2011, in the former leader's hometown of Sirte. The eccentric dictator was killed later that day by revolutionary fighters.

His body was greeted at the airport in his hometown of Misrata by more than 10,000 people for a procession to the soccer stadium for prayers Tuesday and he was buried early Wednesday.

Ousted Libyan dictator Moammar Gadhafi was shown no mercy and brutally killed by the same people he ruled over for more than 40 years. Graphic pictures and videos captured his final moments. NBC's Richard Engel reports.

His brother Hussein complained that the Libyan authorities did nothing to help Shaaban. ?

"Libya was declared liberated of Gadhafi's rule on October 23 last year. It isn't," he told Reuters.

On Tuesday in the capital Tripoli, several hundred protesters gathered outside the headquarters of the National Congress to demand that the government avenge Shaaban's death.

Shaaban's family said that he and three friends had been en route home to the western city of Misrata from a vacation in July when they were attacked by gunmen in an area called el-Shimekh near Bani Walid.

Shaaban and his friends, who like many Libyans were armed, fired back, the family said.

Two bullets hit Shaaban, and he was paralyzed from the waist down, his relatives said, and the men were captured by Bani Walid militiamen.

A town of about 100,000 people, it remains a stronghold of Gadhafi loyalists and is isolated from the rest of Libya.

President Mohammed el-Megarif visited Bani Walid this month and secured the release of Shaaban and two of his companions. A fourth is still being held.

'Sliced with razors'
When Shaaban was finally brought home, he was "skin and bones" ? still paralyzed, frail and slipping in and out of consciousness, according to another brother, Abdullah.

"It was clear he was beaten a lot," Abdullah Shaaban said. "His entire chest was sliced with razors. His face had changed. It wasn't my brother that I knew."

Omran Shaaban was later flown to France for medical treatment.

Shaaban, the second youngest in a family of nine children, was a member of Libya Shield, a loose coalition of the country's largest militias relied on by the Defense Ministry.

Khalifa al-Zawawi, the former head of Misrata's local council, said the government reneged on paying the reward to Shaaban.

Abdullah Shaaban said his brother did not mind, saying he considered capturing Gadhafi to be his national duty.

While Libya's president released a statement Tuesday vowing that those responsible for the violence against Omran Shaaban would be punished,?apprehending and disarming the militants in Bani Walid are among the most daunting tasks facing the government.

The town is heavily armed with rocket-propelled grenades, automatic weapons and artillery left over from last year's civil war.

Residents there say that pictures of Gadhafi are displayed during weddings and youths play his speeches on their cars' stereos. Students refrain from singing Libya's new national anthem and teachers refuse to follow the revised curriculum.

US Ambassador Chris Stevens was 'courageous,' Obama says

Bani Walid fighters were blamed for many of the sniper attacks, shelling, rapes and other violence against the city of Misrata during the civil war, and there were new calls Tuesday from residents of Misrata for vengeance against Bani Walid.

In July, fighters from Misrata threatened to attack Bani Walid after two journalists from their town were detained there. The journalists were eventually released after mediation by the authorities.

Shaaban's eldest brother, Walid, insisted there would be justice for the family, regardless of whether the government is the one to administer it.

"I plan to pursue his rights legally and join if there is a military incursion. We are going to death, God willing," Walid Shaaban said.

Family friend Abu-Shaala echoed that sentiment.

"If the government does not go in, we are going in," he said. "We are all patient. But our patience has limits."

Venturi's touting the car as more than just a smooth pavement flyer though, saying that it has a go-anywhere attitude with its high stance, generous clearance and tough carbon-fiber chassis. Still, if you want to go fast, the car can hit a top speed of 120 mph, and once you've burned off all the volts, can be fast charged in four hours, or ten from a 230V socket. Despite its off-road gumption, the rear-driver has considerable competition for sports EV dollars -- and a smooth road to its 2014 availability target is no given.

Pro sports more gay-friendly as athletes speak out

MINNEAPOLIS (AP) ? NFL punters are only seen on fourth down and heard from less than that. But with Minnesota voters weighing whether to ban gay marriage this fall, Vikings punter Chris Kluwe has emerged as a high-profile gay rights champion ? and a symbol of changing attitudes toward homosexuality in the sports world.

"I'd like to win some votes against the amendment," Kluwe told The Associated Press. "It would permanently change the state constitution. Who are we to say we should decide what our children should do on this subject? If we're not the generation to make gay marriage legal, why should we prevent our children having a say on the matter?"

Kluwe, a colorful 30-year-old with political science and history degrees from UCLA, is known for his love of video games, for getting a perfect score on the verbal portion of the SAT test and for his liberal political views. He agreed some time ago to speak out against Minnesota's amendment and headlined a long-planned fundraiser against the amendment Friday night.

But Kluwe got a massive new audience for his views after he penned a blistering open letter to a Maryland state lawmaker who criticized another NFL player, Brendon Ayanbadejo of the Baltimore Ravens, for supporting gay marriage with the issue also on Maryland's ballot.

"Why do you hate the fact that other people want a chance to live their lives and be happy, even though they may believe in something different than you or act different than you?" Kluwe wrote to Delegate Emmett C. Burns Jr. The full letter, posted by the sports website Deadspin.com, was laced with profanity and sarcasm.

Burns had written to Ravens owner Steve Bisciotti, urging him to restrain Ayanbadejo from speaking publicly on the issue. Kluwe said it was the assault on free speech, not Burns' opposition to gay marriage, that angered him.

Burns did not return a phone call from The Associated Press. A Democrat and a Baptist pastor, he told the Baltimore Sun that "upon reflection" Ayanbadejo has the right to express his views.

In all, four states are voting on gay marriage this year. Minnesota's vote is on a constitutional ban; in Maryland, as well as Maine and Washington, voters are deciding whether gay marriage should be legal.

"I'm just going to continue to voice my First Amendment rights and continue to support the cause," Ayanbadejo said. "There's a lot of work to be done."

The incident evoked memories of a 1998 controversy involving the NFL and homosexuality, but with the roles reversed. Back then, All-Pro defensive end Reggie White of the Green Bay Packers made national news by criticizing homosexuality and gay activists, first in a speech to Wisconsin state lawmakers and later in a full-page advertisement in USA Today. White died in 2004.

Pro athletes and team officials say attitudes have slowly shifted in a sports culture often seen as one of the last bastions of acceptable homophobia.

"We call it casual homophobia," said Patrick Burke, a scout for the NHL's Philadelphia Flyers and founder of the You Can Play Project, which aims to increase acceptance for gay athletes. "Athletes will use slurs like 'that's so gay' or 'don't be a fag' without thinking about what they're really saying. You might think it's harmless, but for that young athlete in the corner who's closeted, it's a huge deal."

No active athlete in the four most popular pro sports ? football, baseball, basketball or hockey ? has come out publicly as gay, according to the gay-oriented sports website Outsports.com.

"I've always called it the last closet in American society," said Jim Buzinski, the site's co-founder. "The fact that no player has ever come out while active, it shows you how entrenched that culture is."

Some players have after retiring. Esera Tuaolo, a retired NFL tackle who played for the Vikings from 1992 to 1996, came out in 2002, explaining he stayed quiet for years when he heard homophobic slurs or taunting in the locker room.

Minnesota Gophers basketball star Trevor Mbakwe joined Kluwe and Tuaolo at the Minneapolis fundraiser.

"To defeat the amendment, we need to aim our message at the independent and moderate, maybe Republican-leaning voters that just haven't thought much about this issue," said Tracy Call, an ad exec for Minnesotans for Equality, which organized the event.

Several sports figures say they were influenced by gay family members. Kluwe has a gay brother-in-law, "and I'd like to see him be able to get married someday," he said.

Connor Barwin, a linebacker for the Houston Texans, has talked about his gay brother and his own support for equal marriage rights. Burke, the NHL scout, had a gay brother who also worked in hockey management but died in a 2010 car accident.

NFL leadership has supported players' right to speak out. League spokesman Greg Aiello said a statement issued a decade ago still holds: "As an institution, the NFL is a meritocracy that also places a high priority on tolerance and diversity ... on that basis an individual's sexual orientation is entirely irrelevant."

In Baltimore, Ravens center Matt Birk said he thought the NFL was evolving toward greater acceptance of homosexuality. He declined to talk about his own feelings on gay marriage, but spoke out strongly in support of other players' freedom to take stands. And he said he was "absolutely" willing to play with a gay teammate.

Some of Kluwe's teammates were more reluctant to talk about it.

"I've just been mainly focusing on getting snaps to him. So I've stayed away from his media blitz," said Cullen Loeffler, the Vikings long snapper who spends as much time with Kluwe as anyone on the team.

But Kluwe said the private response from Vikings players and management has been positive.

"For me personally, what I'm seeing is guys who are willing to live and let live," Kluwe said. "They don't really care about it, and at the end of the day when we're in the locker room, it's what can you do to help us win on Sunday?"

Real Team Building - Online Business Reviews

When you hear the term "team building" , the first thing that may come to mind are things such as ropes courses, a weekend retreat, or some other form of recreational activity that is intended to build camaraderie among a group and inspire them to work better together. In my years of business and consulting experience, I have never seen such activities take a dysfunctional group of people and turn them into a high performance team. Companies waste hundreds of thousands of dollars each year on such activities without any real return for the investment.

The reasons that most of these programs do not achieve substantial results is that they are primarily focused on building relationships among members of a team. Although relationships can impact the functionality of a team, often the source of team ineffectiveness is due to some other factor. One of the most likely causes of poor team performance is lack of goal clarity within the team.

To illustrate this, I can take a group of total strangers in a workshop, assign them a very specific task, and then watch them complete the task with enthusiasm and energy, particularly if the task involves competition with another team. The group works well together because there is a clear and common goal, and they are not distracted by competing priorities at the time they are performing the task. If a team is ineffective, the most likely cause is unclear goals and priorities.

When I work with an executive team, one of the first things that I do is ask each of them to independently write down the organization's top five goals, then we compare the individual lists. This is a real eye opening exercise for most executive teams because usually there are many differences among the lists. Until there is agreement and buy in the company's goals at the top level, it is unrealistic to expect a high level of team work throughout the organization.

Without goal clarity, efforts to improve teamwork by focusing on relationships with will fruitless. In fact, poor goal clarity can create dissension and strained relationships within a group that normally would be very harmonious.

Goals define what the team needs to accomplish. If a team can come to agreement on goals, then most of the discussion should focus on the best way to accomplish the goals. Healthy conflict within the team is needed in order to come up with the best solutions and actions. I have found that if the goal is clear and agreed to by the team, then they can usually come up with the best way to accomplish it.

Gaining goal clarity and commitment cannot be achieved through a contrived team building exercise. It has to be done through frank and open discussion around key business issues. Often a facilitator or coach can be used to keep the group on track and to offer an unbiased, outside view of the situation. A skilled facilitator will be attuned to group dynamics and will ensure that the real issues are surfaced and addressed.

Seattle is sun-splashed while SW deals with rain

SEATTLE (AP) ? Heavy rains and flooding in the Southwest? A near-record dry streak in Seattle?

The seemingly counterintuitive weather is not necessarily unusual for this time of year, but it's striking when compared with the usual opinions about the regions ? overcast and rainy in the Northwest and sunny skies in the Southwest. But late summer is typically the sunniest, driest part of the year in Washington and Oregon, while the Southwest monsoon season stretches into September.

In the Pacific Northwest, high temperatures and bone-dry terrain have made for dangerous fire conditions, particularly in Washington state. More than 1,600 firefighters labored Wednesday on seven large fire complexes in Eastern Washington that were fanned by high winds earlier this week.

Meanwhile, intense summer thunderstorms that struck parts of the Southwest this week flooded homes and streets in the Las Vegas area, inundated mobile home parks in Southern California, stranded some Navajo Nation residents in Arizona, and broke a dike in southern Utah, leading to evacuations.

The conditions may be leaving residents reeling, but they're par for the course this time of year, experts say.

Arizona, for example, has seen much flooding in recent months, with normally dry washes rushing like rivers in parts of the state. Some residents might have the impression that this summer has been extremely wet because of the frequency of rain that they can see from their homes, said J.J. Broston, a science and operations officer for the National Weather Service in Tucson.

But rain falls more diffusely across a region ? and this year has been wet but not record-breaking, he said.

"For the most part, people are looking at rainfall from their own individual perspectives, and if it rains at their homes, they think it has been a wet monsoon (season)," Broston said. "From the Weather Service's perspective, we are looking at a larger area."

Rainfall levels in Arizona so far in the monsoon season that runs from June 15 through Sept. 30 have generally been just above average.

Metro Phoenix and surrounding areas have seen 2.35 inches this season, up from the average of 1.4 inches but nowhere near the record of 9.56 in 1984, according to the National Weather Service.

In southern Arizona, the Tucson International Airport has recorded 5.97 inches of rain this season. That's a half-inch above the average so far in the season, but pales in comparison to the record of 13.84 inches in 1964.

Other southern Arizona cities, however, have seen 2 to 3 inches above their rainfall averages.

In the Las Vegas area, heavy rains this week delayed flights and prompted helicopter rescues of some stranded motorists.

Crews on Wednesday planned to resume their search for a landscape worker who was possibly swept away during a downpour at an area golf course. Police said the man was last seen Tuesday afternoon; photos showed the backhoe he was using almost completely submerged in floodwaters.

More than 1.75 inches of rain was reported in downtown Las Vegas after Tuesday's showers. That puts the region on pace to exceed the 4.5 inches of rain it normally gets in a year.

In Southern California, a thunderstorm settled for six to eight hours over Mecca and Thermal, two towns 150 miles southeast of Los Angeles near the location of the annual Coachella Music Festival. The storm dropped more than the average annual rainfall on parts of the Coachella Valley in one night alone, flooding two mobile home parks.

Meanwhile, drought-striken New Mexico anxiously awaited the leftovers from the storms that drenched other Western cities.

Meteorologists said an upper-level system moving in from the west was expected to collide with a cold front moving down through the heart of New Mexico.

"This is kind of a unique setup in that we've got monsoon moisture in place for these storms to work with," said David Craft, a Weather Service forecaster in Albuquerque. "We are expecting the potential for anywhere from half an inch to an inch and a half of rain across much of northern New Mexico and central New Mexico."

The rain isn't expected to fall all at once, so forecasters have opted not to call for any flood warnings.

It was a different picture in the Northwest, where fire officials said it could be several weeks before any significant rain or snow dampens the numerous wildfires burning in Washington state.

"While we know we will get a season-ending event in the foreseeable future, it still looks like it's a little ways down the road," fire spokeswoman Connie Mehmel said.

In Seattle, a rain shower Sunday night dropped the first measurable moisture since July 23 at Sea-Tac Airport, ending a 48-day dry stretch ? the second longest on record.

Mehmel said firefighters are stretched thin by the number of large fires in the state, but they're putting their best efforts into blazes that could threaten people and property.

Some residents just west of Wenatchee were allowed to return home Wednesday, but about 125 homes were still evacuated by a fire that had grown to more than 1,000 acres. Residents of dozens of other homes were told to be ready to flee if the fire grows.

Near Grand Coulee Dam, three homes and nine outbuildings were confirmed lost to two fires that have burned a combined 92,000 acres ? or 143 square miles. That fire was 20 percent contained Wednesday.

Meteorologist Brent Bower said August and the first half of September are the driest part of the year for the Pacific Northwest.

This year, though, it's a bit drier than usual.

"If you're looking for good summer weather, and if that's defined by dry and sunny, August and September is what you're looking for."

He said wet systems are staying away from Seattle, but he expects rain to come back as September progresses. But for now, the sun will keep shining over often soggy Seattle.

"There really is no rain in the forecast," he said.

McDonald's new menu item: Calorie counts

NEW YORK (AP) ? McDonald's restaurants across the country will soon get a new menu addition: The number of calories in the chain's burgers and fries.

The world's biggest hamburger chain on Wednesday is announcing that it will post calorie information on restaurant and drive-thru menus nationwide starting Monday. The move comes ahead of a regulation that will require major chains to post the information as early as next year.

"We want to voluntarily do this," said Jan Fields, president of McDonald's USA. "We believe it will help educate customers."

In cities such as New York where posting calorie information is already required, however, Fields notes that the information has not changed what customers choose to order.

"When it's all said and done, the menu mix doesn't change," she said. "But I do think people feel better knowing this information."

The Oak Brook, Ill,-based company is also testing healthier options for next year, such as an Egg McMuffin made with egg whites and a whole grain muffin. The sandwich has Canadian bacon and white cheddar cheese and clocks in at 260 calories. It will be called the Egg White Delight.

The chain is also testing versions of the McWrap, which is a bigger version of its Snack Wrap that is already sold in Europe. The wraps have sliced cucumbers and are less than 350 calories.

The moves reflect the pressures McDonald's and other fast-food chains are facing amid growing concerns about obesity. McDonald's is also facing competition from chains such as Subway, which positions itself as a healthy alternative to traditional hamburger chains.

McDonald's notes that it has already made strides in improving the nutrition of its food, such as the automatic inclusion of apple slices in its Happy Meals.

And this summer, McDonald's rolled out a "Favorites Under 400" campaign that highlighted the menu items that had fewer than 400 calories. The company noted that about 80 percent of its menu items fit the bill.

Of course, not everyone orders just one item. And the chain has been blamed by critics for fueling obesity rates with its big soft drinks and other items.

A meal consisting of a Big Mac and medium fries, for example, has 920 calories. Add a 16-ounce Coca-Cola, and the count rises to 1,140 calories.

The decision to post calorie information follows the Supreme Court's decision this summer to uphold President Barack Obama's health care overhaul, which requires restaurant chains with more than 20 locations to post calorie information. The timing of carrying out that requirement has yet to be worked out.

McDonald's, which has 14,000 locations in the U.S., doesn't plan to advertise the posting of the calorie information. Fields said it's something the chain is doing as a "customer convenience."

Scammers already at work with iPhone ruses

It's just a fact:?Apple fans have an insatiable thirst for all things Apple. The notoriously secretive company has cultivated a curtain of mystique that millions are dying to peek behind. Scammers know this and, on the eve of the most anticipated device release of the year, they?re prepared to take advantage of all those queries for "iPhone 5," as some are referring to it.

Believe it or not, the iPhone 5 has already been the apple of scammers' eyes for quite some time now.

Late last month, the much-anticipated phone was the subject of an email phishing scam that took advantage of vulnerability in Adobe Flash. "IPhone 5 Battery Images Leak!!" read the subject line of the malicious message. But instead of exciting battery photos, those link-clickers were left with a Trojan instead.

In February, scammers sent iPhone users texts with an offer to "test" the iPhone 5. They were then prompted to follow a link and enter their personal information ? never mind the fact that the?device hadn?t even been announced yet.

But before then, last September, Facebook pages with titles like "iPhone 5 Giveaway"?began popping up. They led users to a page where again they were asked to share personal details. If you gave yours up, you got nothing in return.?

Even before that, in May of 2011, not even a year after the release of the iPhone 4, scammers were counting on consumer impatience. Official-looking emails from Apple subject-lined "Finally. The amazing iPhone 5"?delivered little more than a phishing scam and a malicious Windows file (and that phone wound up being called the iPhone 4S, anyway).

When the device finally does come out Wednesday, as expected, there will be a wealth of information, reviews, analysis play-by-play and everything else diehard Apple fans need to get their fix. Make sure that you get your news from reputable sources. Check your URLs. If it looks suspicious or unfamiliar ? stay away.?

Also, remember not to input your identifying information on any sites unless you?re absolutely sure you know who it?s going to. This is where it?s especially important to check the address bar and make sure you have a secure connection. And remember, there are no free iPhones or special giveaways or anything else like that. If it sounds too good ? You know the rest.?

Olympic skater Kristi Yamaguchi launches fashion line

LOS ANGELES (Reuters) - Olympic figure skating champion Kristi Yamaguchi, 41, has launched a fashion line called Tsu.ya, featuring t-shirts, leggings, jackets and other active wear.

Yamaguchi spoke to Reuters about her post-skating career and life with her two daughters and her husband, retired professional hockey player Bret Hedican.

Q: What's behind the name Tsu.ya?

A: "It's actually my middle name, and it was my grand-mother's name. I liked it because it's a nod to my Japanese heritage. We put the period in there because we thought it would break it up and make it easier to pronounce. And it looks good too."

Q: Have you always been interested in fashion?

A: "I'd always been interested in developing some type of line. Now as an active mom, I was looking for clothes that fit into my current lifestyle and could accommodate other busy women out there."

Q: What makes your line of active wear different from others?

A: "I wanted to infuse fashion into the active wear ... I wanted to do something feminine, something that could go from the gym to other areas of your life, whether you're running errands or carpooling the kids.

"I also wanted to create a brand that gave back to the community. A portion of the proceeds of Tsu.ya go back to my foundation, Always Dream Foundation, which supports childhood literacy."

Q: Do you have a favorite item in the line?

A: "There's this one jacket - part of the line is called Flirt and it has ruffles for the accents. I find myself wearing that jacket quite a bit. It's comfortable, lightweight and has a nice silhouette. The ruffles make it fun."

Q: Do any of your girls exhibit your talent on the ice?

A: "The younger one has been skating since last November and loves it. But I don't see a lot of me in her - she's just not very focused! (laughs) Also, she has a different body type and a different cadence on the ice than I did. But I could care less whether she ends up competing or not. I just like to see her smiling out there."

Q: Do you find yourself resisting the urge to correct her?

A: "Oh yeah, all the time! (laughs) And I do correct, but I'm not sure she listens!"

Q: When was the last time you were on the ice?

A: "I haven't performed in almost three years. I never officially retired from the ice and don't want to because who knows what can happen? I would really have to change my lifestyle to spend more time in the rink and train if I wanted to perform again. As of now, I'm happy with the path I'm on."

Q: You've teamed up with Smucker's Uncrustables sandwiches for a photo contest. What is that about?

A: "People can submit photos to www.uncrustables.com of their family doing something fun with their sandwiches. Then they are eligible to win a $15,000 check towards a family vacation. ... It's all about being an 'unstoppable' family, which my husband and I consider ourselves to be, having kids and running from place to place."

The two baby-faced gay fathers of "The New Normal"?exemplify the new breed of television's trying-too-hard superdad. From "Modern Family"?to "Parenthood"?to "Up All Night"?to "Guys With Kids," the sitcom staple has now become Dad as a panicky man-child in way over his head with adult responsibilities. Their sexuality takes a backseat to their desire to be Fred MacMurray; the real key to them is ? and these dudes can't shut up about it ? they?want?to be the family man. Unlike the sitcom dads of old ? Fred Flintstone, Archie Bunker or Al Bundy ? they're desperate to get it right.

The basic sitcom formula remains unchanged: You might recognize the kids (they are sassy!) and the moms (they are humorless-yet-wise tsk-tskers!) as straight from the clich? vaults, yet the megasincere dads are the ones who dominate. It's like cop shows, except the dads are now the wide-eyed recruits fresh from the police academy and the moms are their street-smart partners who grumble, "Listen, rookie, it's murder out here."

Before reality TV came along, prime time was filled with dysfunctional dads. But these days, if you want to see a loudmouth jerk slobbering with resentment, you have way too many reality-TV families competing for your attention. Hell, even Fred Sanford and his idiot son liked each other more than any of the Kardashians do. If you get your kicks watching loathsome families chew one another to shreds, why would you watch a sitcom? There's always "Toddlers & Tiaras"?or "Here Comes Honey Boo Boo."

"The New Normal"?is auteur Ryan Murphy doing "Modern Family," but upping the gay-dad ante. It's the crowning act of Murphy's American-family trilogy, which he began with "Glee"?and continued with "American Horror Story," both nightmares about how horrific families are and how you'll lie, steal, cheat or kill to escape. Now Murphy ventures into the heart of darkness: the sitcom, which has always been obsessed with the idea of the nuclear family. This is strange territory for Murphy, who has specialized in revenge fantasies about wiping out Mayberry with extreme prejudice.

At the center, there's a Los Angeles gay couple (Justin Bartha and Andrew Rannells) who crave a surrogate baby. Their designated womb-haver: earthy Midwestern gal Goldie. She already has a daughter from when she got pregnant at 15. As she tells the boys, "I became a mom in a Rite Aid bathroom." She also has a foxy grandmother: Ellen Barkin, kicking ass in the Jane Lynch/Jessica Lange nasty-blonde role. Barkin has considerably tougher comic chops than the rest of the cast, so she gets nearly all the laughs, spewing homophobic slurs like "salami smokers" and "ass campers."

"The New Normal"?isn't brilliant comedy at this point. There are lots of speeches about what love and family?really?mean. But it's in a long, noble tradition of sitcom families looking to invent the new normal while keeping it as close as logistically possible to the old one. In the Seventies, that meant "The Brady Bunch"?and "The Partridge Family," which were so outr? they required theme songs that nervously explained how these single women got all these kids. Same with?"The Odd Couple," which had to begin every show with a voice-over explaining that Felix wasn't gay.

The next two decades saw an explosion of new-normal templates, with (expletive) loads of single moms keeping it together one day at a time. Those aggressively funky families still define the state of the art, from "Fish," with Abe Vigoda in a house full of racially polarized orphans, to "Diff'rent Strokes," where one of the kids from Fish plus another from "Good Times"?get adopted by that capitalist (expletive) Mr. Drummond.

It's a long road from "The Brady Bunch"?to "One Day at a Time"?to "Modern Family." This is the tradition that "The New Normal"?comes from: the history of the American family that sitcoms invented, and have been furiously reinventing ever since.
